LEGAL BASIS OF THE VIRTUAL CHRISTMAS CONTEST "THE TASTE OF CHRISTMAS" FOR SACYR EMPLOYEES

ORGANIZING COMPANY

SACYR S.A. (hereinafter "SACYR") with registered office at Condesa de Venadito 7, 28027 Madrid (Spain) and Tax ID number A28013811, organizes two contests that will be held in accordance with these rules.

NAME AND MAIN ASPECTS

DURATION

The deadline to participate in both contests will run from 12:00 a.m. on November 15, 2024 to 23:59 p.m. (Spanish peninsular time) on December 9, 2024.

WINNER SELECTION DATE

Selection of the winning entries will take place on December 17, 2024. SACYR reserves the right to modify this date because of force majeure or duly justified cause.

COST- FREE

Participation in the contest is free. Participation in it does not require any type of purchase, payment or fee of any kind, neither to be a participant, nor to obtain the prize, in case of being selected winner.

CONTEST RESULT COMMUNICATION

The contest results will be communicated to employees on the same day as the "The Taste of Christmas" event

TERMS AND CONDITIONS FOR PARTICIPATION in the contests

Participants must be Sacyr employees, and log in to the website with their corporate email with a @sacyr.com domain.

Christmas Meme Contest:

1. Format and submission:
   • Participants must upload a Christmas-themed meme image.
   • Only one image per participant is allowed.
   • The meme must be an original creation and not infringe copyright.
2. Rules of conduct:
   • Images that contain violent, offensive, discriminatory or hateful content will not be allowed.
   • Submitted memes should be humorous in tone, respectful and in keeping with the Christmas spirit.
3. Transfer of rights:
   • By participating in the contest, users assign to Sacyr the rights to use their image for broadcast on the Christmas program "The Taste of Christmas", as well as on the website of said program.
4. Selection and awards:
   • The winner will be selected by a jury comprising Sacyr´s Communication teammembers
   • The award will be announced during the broadcast of Sacyr´s Christmas program "The Taste of Christmas"

Important notice: Sacyr reserves the right to remove any video or image that does not meet the requirements or that does not respect the contest rules.

1. Format and submission:
   • Participants must upload a video in vertical format (TikTok style) that shows a hidden talent.
   • The video must be dynamic and fun and have a maximum duration of 30 seconds.
   • Only one video per participant will be allowed.
2. Rules of conduct:
   • Content that is violent, offensive, discriminatory, or hateful will be immediately disqualified.
   • The video should be creative and respectful, in line with the Christmas spirit.
3. Transfer of rights:
   • By participating, users allow Sacyr to use their video for broadcast on the Christmas program "The Taste of Christmas", as well as on the program´s website.
4. Selection and awards:
   • The winner will be selected by a jury comprising Sacyr´s Communication team members.
   • The award will be announced during the broadcast of Sacyr´s Christmas program " The Taste of Christmas "

Important note: Sacyr reserves the right to remove any video or image that does not meet the requirements or that does not respect the contest rules..

PRIZE

The prizes will consist of:

1. Christmas Meme Contest:
   • Winner: 100 euros
   • Runner-up: 50 euros

Talent Show:
• Winner: 200 euros
• Runner-up: 100 euros

TAXATION OF THE AWARD

The prizes of these contests are subject to taxation in the Personal Income Tax or in the Non-Resident Income Tax, depending on the tax residence of the winner, as a capital gain.

It will be the exclusive responsibility of the winner to comply with their tax obligations that may arise from obtaining the prize described in these rules, and SACYR will not be held responsible in this regard.

PROCESSING OF PERSONAL DATA

The personal data provided by participants when joining the contests, including those they provide in the event of being a winner, will be processed by SACYR for the purpose of (i) managing these contests, publication of the winner, as well as the delivery of the corresponding prize and other communications, information and promotion tasks associated with the contests draw, in the terms provided for in these legal bases, and (ii) comply with legal obligations.

If the participant does not provide the requested data or if he/she postpones or withdraws his/her consent (e.g. the winner deletes his/her content after his/her designation and before SACYR effectively communicates it) to use said data, the refusal to deliver the prize may be caused.

SACYR will keep the data of the participants in these contests for the period of time necessary for the management of participation in the contests -including, where appropriate, the subsequent delivery of the prize-, and until the expiry of the limitation period for the possible legal actions associated with said participation

The participant guarantees that the data provided, in their case, is true, accurate, complete and up-to-date, and is responsible for any damage, direct or indirect, that may be caused as a result of non-compliance with this obligation. In the event that the data provided, in their case, belongs to a third party, the participant guarantees that they have informed said third party of the aspects contained in these legal bases and obtained their authorisation to provide their data to SACYR for the purposes indicated.

SACYR will not communicate the personal data of the participants to third parties, unless required by law or in the event that the appropriate consent has been received. Participants in the contests may exercise their rights of access, rectification, deletion, opposition, limitation of processing and portability, when applicable, and oppose receiving information, by requesting the Data Protection Department of SACYR, located at Calle Condesa de Venadito, 7, 28027 – Madrid or by email to the following address proteccióndedatos@sacyr.com. Likewise, you may contact the DPO of SACYR, at the address dpo@sacyr.com or the Spanish Data Protection Agency in the event of any complaint.

The cancellation of the data necessary for the management of these contests - including, where appropriate, for the subsequent delivery of the prize - will mean the automatic cancellation of the contests.

SACYR does not guarantee the availability, continuity or infallibility of the operation of the aforementioned platform or of any other mechanisms used to carry out the contests and, consequently, it is exempt, to the maximum extent permitted by current Spanish legislation, from any liability arising from damages of any kind that may be due to the lack of availability. continuity or malfunction of said platform.
